fix: add proper error raising in workspace.resolveUpstream() and remove dead code (#11)

...The dead code: this is code that was clearly not reached before our fix and that would now be reached in some cases.
Instead of introducing a how block of never tested, previously dead code, this commit just drops it.
The reasoning is that IF this code is really important, we should add it in a follow-up PR, with respective testing
and review.
